The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, includingthe scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the the termination of these Terms and Conditions.

Indemnification

You agree to indemnify Cinnasticks3D and its affiliates and hold Cinnasticks3D harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel.

Limitation on liability

Cinnasticks3D is not liable for any damages that may occur to you as a result of your use or misuse of our website.

Cinnasticks3D reserves the right to edit, modify, and change this Agreement at any time. We shall let our users know of these changes through electronic mail. Commission Policy

By submitting a commission request form, Cinnasticks3D (ARTIST) is under no obligation to fulfill your order up and until scope has been approved and payment has been received.

ARTIST RIGHTS
The ARTIST retains full copyright to all creative works and intellectual property. The ARTIST reserves the right to use, sell, promote, and market any commissioned works. The ARTIST reserves the right to refuse service for any reason.

COMMISSIONERS RIGHTS
The COMMISSIONER has the right to non-commercially distribute their commissioned art as they see fit, so long as the ARTIST is appropriately attributed. The COMMISSIONER does not have the right to alter, change, or edit the commissioned work in any way. The COMMISSIONER does not have the right to the commercial sale of the work without prior authorization from the ARTIST. The COMMISSIONER holds no copyright to the creative works.

PAYMENT
Once scope and price have been determined, payment is to be received upfront. Once full payment has been secured, the ARTIST will complete the work as scoped.

CHANGE IN PROJECT SCOPE
Any significant change to a project's scope will incur additional cost to be determined by the ARTIST. No additional work will be made until any additional cost is paid. Minor revisions are allowed at no cost and are at the discretion of the ARTIST.

FULFILLMENT

Once payment is successful, commissions will be fulfilled within 30 days of purchase, unless otherwise stated by ARTIST. If a commissioned work is not delivered within 30 days, the project is immediately set as high priority and will be completed before any other project. Changes project scope will not be affected by this agreement, as it may add additional time to complete the commissioned work to meet the requirements of the new scope. This additional time is to be determined by the ARTIST.
